Muslim couple in Kerala remarries under Special Marriage Act to secure daughters’ future

The couple, whose nikah originally took place on Oct 6, 1994, got remarried this time under the Special Marriage Act of 1954 instead of the Muslim Personal Law.

THIRUVANANTHAPURAM – A Muslim couple from Kerala’s Kasaragod remarried on Wednesday on the occasion of International Women’s Day to ensure the financial security of their three daughters .

Advocate C Shukkur, who is known for his role as a lawyer in the Kunchacko Boban starrer ‘Nna Thaan Case Kodu’ (Sue Me Then), remarried his wife Sheena Shukkur, former Pro-Vice Chancellor of Mahatma Gandhi University, Kottayam, at the Sub-Registrar’s office at Kanhangad in Kasaragod district

The couple, whose nikah originally took place on October 6, 1994, got remarried this time under the Special Marriage Act of 1954 instead of the Muslim Personal Law.

The couple took the special route to re-register their marriage due to certain conditions imposed in Muslim inheritance laws. As per the Muslim inheritance laws, daughters will only get two-thirds of their father’s property and the rest will go to his brothers in the absence of a male heir.

In a Facebook post, Shukkur said that he met with accidents twice, from which he had narrowly escaped.

“I have met with accidents twice, from which I had narrow escapes. This had me thinking about what would happen after I left the world. I want my girl children to be the sole heir of my property,” Shukkur said.

Under Sharia law, leaving behind a will is not permitted, he further said in his post.

The Special Marriage Act says that the succession to the property of any person solemnised under the Act will be governed by the Indian Succession Act.
