The party had to adjourn its general assembly because only 223 voting members had shown up, instead of the 250 required by the party’s charter.
After receiving clarification from the ombudsmen, the Constitutional Court will meet at 7.30pm on August 19 to consider whether it will accept the petition for a judicial review.
Despite winning the May 14 election with 151 Lower House seats, the Move Forward Party and Mr Pita Limjaroenrat have been unable to form the government.
Meanwhile, police still had their security plan in place for the parliamentary meeting as it remained unclear whether protesters would gather near the Parliament building.
The latest development on the delay in Thaksin’s return comes amidst reports that the parliamentary vote on Thailand’s next prime minister would not be held on August 4.

However, the party would still work wholeheartedly to push forward its political ideology, said party secretary-general Chaithawat Tulathon.
Now that it has backed away from the eight-party alliance, Pheu Thai will likely have no option but to join junta-backed parties to ensure sufficient parliamentary votes.
A representative said that the lack of progress these days is eroding business confidence to invest further, which is not good for the country's competitiveness.
